USDA Finalizes Historic Regulatory Reform in NEPA Final Rule

On Tuesday, April 7, the U.S. Department of Agriculture (USDA) finalized a rule updating its National Environmental Policy Act (NEPA) implementing regulations. The rule makes permanent the changes introduced in an Interim Final Rule published in July 2025, consolidating seven agency-specific NEPA regulations into a single department-wide framework — a reduction of approximately 66 percent in overall regulatory volume.

According to USDA, the revised framework is intended to shorten environmental review timelines and reduce administrative costs. The changes affect permitting and project delivery across USDA programs, including rural loans, infrastructure funding, and forest management activities. The rule is expected to affect timelines for projects serving rural communities, farmers, ranchers, and local governments that rely on USDA program funding.

The action follows the Council on Environmental Quality’s April 2025 rescission of its government-wide NEPA implementing regulations and supports Executive Order 14154 on domestic energy development. The final rule applies only to USDA agencies and does not alter the underlying NEPA statute.
