RCRC’s Rural Rundown of the 2023-24 State Budget Package, Updated June 30, 2023

On June 27th, the Legislature approved and sent to the Governor for signature, a series of measures to “fill out” Senate Bill 101 (Skinner), the Budget Bill framework approved by the Legislature on June 15th. Governor Newsom signed the aforementioned 2023-24 State Budget Bill (Senate Bill 101) on June 27th.  

As noted above, SB 101 enacted the main budget framework for 2023-25 as well as set the foundation for ongoing negotiations between the Legislature and the Governor. Interestingly, the roughly $31.5 billion deficit did not end up being the biggest obstacle to reaching a budget deal. The most contentious component reportedly revolved around the Governor’s push for a series of proposals accelerating infrastructure development, including the Delta Conveyance facility (raising the ire of Delta-area legislators, environmental representatives and others in the Delta).  

Tuesday’s actions reflect a compromise that, while it jettisoned the controversial Delta project, did include “streamlining environmental review” for other infrastructure projects, allowing an agreement to be reached. The inclusion of these provisions continues the trend of using the budget for policy changes that, otherwise, would have gone through the more transparent legislative committee process. 

As part of the agreement, a raft of budget-related measures were introduced over the past weekend and, while most pertain to the Budget, roughly 500 “special projects” are receiving appropriations totaling approximately $750 million.

Bill of the Week: Assembly Bill 388 (Connolly) – Wildfire and Forest Resilience Action Plan: Implementation Strategies: Roadmap

RCRC supports Assembly Bill 388, authored by Assembly Member Damon Connolly (D-San Rafael), which requires the Department of Conservation (DOC) to establish guidelines and regional investment strategies for larger landscape level projects that contribute to the achievement of the goals of the implementation strategy for the Wildfire and Forest Resilience Action Plan.  

Landscape-scale, regional fuels treatment projects are a vital part of decreasing the state’s overall risk of catastrophic wildfire. Currently, California lacks a comprehensive, cohesive strategy for investment and coordination to promote forest resilience efforts across local boundaries or to regionalize projects, even as the state continues to set ambitious forest resilience goals.  

AB 388 would improve the health of California’s forests and wildlands by enabling larger, landscape scale forest resilience projects. DOC already has the structure through the Regional Forest and Fire Capacity Program to advance regional resilience projects; AB 388 would require DOC to further use the program to develop regional investment strategies and regional funding guidelines while enabling California Natural Resources Agency departments and agencies to award block grants to regional entities to implement regional, landscape-scale projects.

California To Receive More Than $1.8 Billion To Advance Broadband Deployment

On June 26, 2023, the US Department of Commerce’s National Telecommunications and Information Agency (NTIA) announced how the $42.5 billion allocated for digital equity and broadband deployment under the Broadband Equity, Access, and Deployment (BEAD) program will be distributed among 50 states, the District of Columbia, and five territories. California is the second highest recipient of funds, behind Texas, and will receive more than $1.8 billion ($1,864,136,508) for broadband deployment and digital equity advancement.

BEAD funding will be used to deploy or upgrade broadband networks to ensure that everyone has access to reliable, affordable, high-speed internet service. Once deployment goals are met, any remaining funding can be used to pursue eligible access, adoption, and equity-related uses.

In order to receive the allocated funds, each state (district and territory) must develop and submit a broadband and digital equity plan to NTIA for review and acceptance. The California Public Utilities Commission and the California Department of Technology and are leading the development of California’s plans. It is anticipated that this source of funding will be available for distribution and deployment in California sometime in 2024. GSFA Celebrates 30 Years Paving a Path to Homeownership

This year, Golden State Finance Authority (GSFA) celebrates 30 years paving a path to homeownership for low-and-moderate income California households, having helped over 85,000 individuals and families to purchase a home and provided more than $660 million in down payment and closing cost assistance. 

GSFA was organized as a Joint Powers Authority (JPA) in 1993 by the Rural County Representatives of California and represented 18 counties in California. Today membership includes 56 counties and hundreds of cities across California with financial assistance programs throughout the state. 

In 2010, GSFA expanded its operations into the provision of energy efficiency financing programs for residential and commercial properties. These programs were designed to help property owners improve energy costs, reduce the environmental impact of energy use and demand, and boost California’s economy through job creation.  To-date, GSFA has participated in financing over 36,000 residential and commercial energy efficiency projects, totaling over $1 billion.

Ten years later, GSFA expanded its services even further, becoming a conduit for developers and contractors to access rebates for the installation of energy storage technology at both residential and commercial facilities. By providing bridge financing between grant approval and reimbursement, the financial hurdles for qualifying residents would be lightened, resulting in getting services to those who need it the most as efficiently as possible.

“Providing the best products and services possible while developing strong relationships with business partners that make our endeavors viable is the heart of our organization, said Craig Ferguson, Deputy Director of GSFA. “At times this means juggling challenging financial markets and shifting priorities as the real estate market fluctuates. Golden State Finance Authority Releases New Episode of Journey to Home Ownership Series

Golden State Finance Authority (GSFA) has released a new episode of the Journey to Homeownership Series. In this episode, GSFA Director of Marketing and Stakeholder Relations, Carolyn Sunseri, talks with one Tulare County employee, Christian Park, about his experience finding and purchasing his first home using GSFA’s Assist-to-Own program. This program provides special down payment and closing cost assistance for employees of GSFA member counties. In their conversation, Mr. Park explores how his life has changed since becoming a homeowner, the new responsibilities, and the advantages of owning property. Additionally, he discusses how he was able to overcome the barriers to homeownership with help from GSFA down payment assistance.

GSNR President and CEO, Greg Norton, Recognized Upon his Retirement for Years of Dedicated Service 

After more than 20 years of dedicated leadership serving the Rural County Representatives of California (RCRC), Golden State Natural Resources (GSNR), and Golden State Finance Authority (GSFA), GSNR President and CEO Greg Norton officially entered retirement as of June 30th. His retirement was honored during the June meeting of the GSNR Board of Directors by Board Chair Matt Kingsley with the presentation of a resolution recognizing his years of committed service to rural counties.

During his tenure, Mr. Norton has been a staunch advocate for rural counties and a key driver in advancing GSNR's forest resiliency mission. As the CEO of RCRC, Greg directed advocacy efforts to amplify the voice of rural counties at the local, state, and federal levels. He also oversaw the work of RCRC’s affiliate entities to improve the quality of life in rural California. As the Executive Director of GSFA, Greg was integral in securing a 20-year Master Stewardship Agreement (MSA) with the United States Forest Service that helped pave the way for GSNR. And since assuming the role of GSNR's President & CEO, Greg has also been at the forefront of efforts to reduce excess biomass in California's forests, build wildfire and forest resilience, and stimulate economic opportunities in rural communities.

Since announcing his retirement, Greg has worked closely with GSNR and RCRC staff to ensure a smooth leadership transition for GSNR and sustained progress of GSNR's forest resiliency mission.

EPA Announces Over $50 Million to Assist Small, Underserved, and Disadvantaged Communities in Accessing Clean and Safe Drinking Water 

On June 26th, the U.S. Environmental Protection Agency (EPA) announced $50.4 million in annual funding to support projects and activities in underserved, small and disadvantaged communities to access and invest in water infrastructure and comply with the Safe Drinking Water Act (SDWA). California received an 11.8% increase in funding over 2022.  

  •  For FY 2022 and FY 2023, the EPA is also applying a waiver of the statutory 10 percent cost share to all grant applicants due to continued supply chain issues, increased costs, and addressing compliance with the Build America, Buy America (BABA) Act and will be provided at the discretion of EPA. Applications are accepted through https://www.grants.gov. This is an ongoing process.

  • The regions will approve the final grant application package prior to submittal of the final application into grants.gov.

Sara Bratsch, of Tulare County, has been appointed to serve as a Judge in the Tulare County Superior Court. Bratsch has been a Sole Practitioner since 2010. She was an Associate at Houk and Hornburg LLP from 2008 to 2010 and served as a Conflict Attorney at the Tulare County Conflict Defender's Office from 2008 to 2009. Bratsch served both as a Deputy District Attorney and a Supervising Deputy District Attorney at the Tulare County District Attorney’s Office from 1997 to 2007. She served as a Law Clerk in the San Diego County District Attorney’s Office Family Support Division from 1996 to 1997 Bratsch earned a Juris Doctor degree from the Thomas Jefferson School of Law. She fills the vacancy of a new position created on July 1, 2022. She is a Democrat.The compensation for this position is $231,174.

Catherine Hohenwarter, of Yolo County, has been appointed to serve as a Judge in the Yolo County Superior Court. Hohenwarter has served as a Commissioner at the Yolo County Superior Court since 2020 and has held several positions there since 2007, including Judge Pro Tem, Family Law Facilitator, Family Court Services Manager, Self-Help Attorney and Legal Research Attorney. She was a Sole Practitioner from 1999 to 2007 and an Associate at the Law Office of Robert P. Kahn from 1994 to 1998. Hohenwarter was an Associate at Lossing & Elston from 1990 to 1994. Jason Johnson, of Napa, has been appointed to the Milton Marks “Little Hoover” Commission on California State Government Organization and Economy. Johnson was Managing Partner at Founders Den from 2011 to 2022. He was Founder and Chief Executive Officer at August Home Inc. from 2012 to 2021. Johnson was Vice President of Marketing and Business Development at Dolby Laboratories Inc. from 2004 to 2010. He was Vice President of Marketing and Business Development at Global IP Solutions from 2001 to 2002. Johnson was Channel Marketing Manager at Tut Systems from 1996 to 1997. He was Distribution Channel Manager at Apple Computer Inc. from 1993 to 1996. Johnson is a member of the Land Trust of Napa County Board of Trustees and Founders Pledge. Kristi Pawlowski, of Mather, has been appointed to the Veterinary Medical Board. Pawlowski has been Chief Insight Director for the Insight Veterinary Wellness Center since 2020. She has been Executive Director at the Sacramento Valley Veterinary Medical Association since 1991. She was Owner and Hospital Manager of Banfield Pet Hospital of Lincoln from 2007 to 2016 and of Banfield Pet Hospital of Folsom from 2002 to 2016. Pawlowski earned a Bachelor of Science degree in Human Resources and Organizational Behavior from California State University, Sacramento. This position does not require Senate confirmation and the compensation is $100 per diem. Pawlowski is a Democrat.

Lake Tahoe Destination Stewardship Plan to address tourism and outdoor recreation challenges – Roseville Today

An unprecedented group of Lake Tahoe destination management, land management, and non-profit organizations launched the Lake Tahoe Destination Stewardship Plan with the signing of an agreement to create the first destination stewardship council for the greater Tahoe region. The plan outlines a comprehensive framework and sets in motion action priorities to better manage outdoor recreation and tourism and ensure the sustainability and preservation of an iconic natural treasure and its local community.

 

California Senator introduces voluntary agricultural land repurposing bill – The Center Square

U.S. Senator Alex Padilla introduced a bill that he hopes will bolster water supply. Padilla introduced the Voluntary Agricultural Land Repurposing Act. It would provide funding to states that voluntarily repurpose certain agricultural lands. Padilla filed the bill in response to the Colorado River Basin’s water shortage, the Great Salt Lake's declining water supply, and groundwater overdraft in California's Central Valley, among other issues.

 

USDA Grants Millions in Rural Broadband ReConnect Program – AG Information Network of the West

The U.S. Department of Agriculture is offering $714 million in grants and loans to connect thousands of rural Americans to affordable, high-speed internet. The federal government has earmarked this funding as part of the Administration’s ReConnect program, which offers the private sector funding to assist in covering the cost of construction for revamping the infrastructure.

AB 6   (Friedman)   Transportation planning: regional transportation plans: Solutions for Congested Corridors Program: reduction of greenhouse gas emissions.   Amends reporting and transportation project review requirements, under SB 375 (2008), for the state’s 18 metropolitan planning organizations (MPOs), for project information pertaining to climate and greenhouse gas emissions impacts. Requires MPOs to send technical methodologies to CA Air Resources Board for review before project selection and approval can commence. Additionally, the bill requires any project nominated by local or regional transportation agencies for Solutions for Congested Corridors funding to demonstrate how the project would reduce greenhouse gas emissions in compliance with state targets.   Location: Senate Transportation   Status: 6/14/2023-Referred to Coms. on TRANS. and E.Q.   Position:   Oppose   Staff:  Sidd (1)

AB 7   (Friedman)   Transportation: planning: project selection processes.   Requires all transportation projects funded, at least in part, through major state or federal funding programs to incorporate several, specified principles that include improving road safety, conformity with federal streamlined project principles, ADA compliance, water and air quality impacts, climate impacts, and access to disadvantaged communities, among others. AB 50   (Wood)   Public utilities: timely service: customer energization.   Seeks to establish clear expectations for how quickly utilities are expected to deliver service to new customers and fulfill requests for increased load from existing customers. Invests the CPUC with authority to determine what constitutes the timely provision of electrical service and fulfillment of requests to provide additional capacity. Requires utilities to refine their distribution planning processes to work more collaboratively with local governments and ensure that the projected demand for a given planning cycle more closely matches the actual demand for service. The bill would require that the principles and guidelines provide for the development of watershed-level plans to support public trust uses, public health and safety, and the human right to water in times of water shortage, among other things. Authorizes State Board to issue a cease and desist order when a diversion or use violates or threatens to violate an applicable limitation or requirement adopted by the state board for the diversion and use of water in specified coastal watersheds during times of water shortage. AB 1484   (Zbur)   Temporary public employees.   While AB 1484 is ostensibly intended to benefit temporary employees of local public agencies, in reality, it will directly harm these employees by severely limiting their future opportunities for temporary employment. This bill would: inflexibly mandate that temporary employees must be included within the same bargaining unit as permanent employees; and that the wages, hours, plus terms and conditions of employment for both temporary and permanent employees must be bargained together in a single memorandum of understanding. AB 1713   (Gipson)   Local agencies: federal funds: reports.   AB 1713 would require state agencies that receive federal funds subject to an expiration date to submit a written report to the Legislature no later than one year before the funding expiration date with a summary of how funds have been expended, and to provide a plan for the remaining funds to be expended. The bill would also require local agencies to include a similar report on an agenda of a public meeting of their legislative body. Local governments rely on federal funding to provide numerous local services on behalf of the state, much of which is associated with our role as the provider of federal entitlement programs, like Medi-Cal, CalWORKs, etc. Accordingly, local governments seek to maximize federal funding opportunities to provide these necessary services to the residents we serve. SB 672   (McGuire)   Residential property insurance.   Requires CA Department of Transportation to establish a standard fee structure for the application and placement of a parklet on a state highway, as specified. Prohibits the department from charging an encroachment permit fee for the application and placement of a parklet on a state highway. The bill would require the department to consider an encroachment permit application for commercial use.
